Department of Labor to File “Request for Information” Regarding Overtime Rule
The Department of Labor (DOL) will be seeking opinions regarding the Fair Labor Standards Act’s (FLSA) white collar exemptions, first introduced under the Obama Administration. Secretary of Labor Alexander Acosta has indicated that the DOL will be filing a Request for Information (RFI) “that would solicit feedback from the public on the salary increase issue”. Acosta has stated that he believes a salary level increase is necessary, saying that “any rule that has a dollar amount that isn’t updated for as long as this [the current salary base] has been is a problem because life gets a lot more expensive”. Employers should use the Request for Information as an opportunity to voice concerns as any impact to the Overtime Rule would bring significant change.
