FLSA Overtime Regulations Appeal Delayed to Later This Year

The US Department of Labor (DOL) has requested a third extension from the Fifth Circuit Court of Appeals “to allow incoming leadership personnel adequate time to consider the issues” regarding the FLSA’s new Overtime Rule. The salary threshold changes were put on hold in November 2016, less than two weeks before they were to go into effect. The new deadline for the DOL to file the reply brief is June 30, 2017, pushing a ruling on the FLSA regulations to either Summer of Fall of 2017.
