New Movement on DOL’s White Collar Overtime Exemptions

The government has asked the Fifth Circuit Court of Appeals to reverse last year’s decision by a Texas District Court judge to block the Department of Labor’s (DOL) Final Rule on white collar exemptions. The Final Rule “would have more than doubled the required salary level for the ‘white collar’ overtime exemptions under the Fair Labor Standards Act”. The DOL “has decided not to advocate for the specific salary level” at this time, but it does plan to “determine what the salary level should be”. As previously mentioned, the DOL has announced a “Request for Information” to gather comments from the public regarding the overtime rule. Employers should pay close attention to the DOL’s actions regarding the Final Rule in order to properly prepare for any necessary changes.
