New York Executive Order: Ensuring Pay Equality

Earlier this month, NY Governor Andrew Cuomo signed an executive order that aims to ensure pay equity in the state. Executive Order 161 prevents New York State entities from asking job applicants for their current or prior salary information “until a conditional offer of employment with compensation has been extended”. New York employers in the private sector are not affected by the order, but it is expected that legislation relevant to them will follow. California and Massachusetts have already passed similar laws prohibiting employers from asking applicants about their salary history.
