NYC Employers To Be Banned from Inquiring About Salary History
In an effort to address the gender pay gap, effective October 31, 2017, NYC employers will no longer be lawfully able to ask candidates about their salary history, and instead will be required to “set a pay level that fits the job”. While employers will be banned from directly inquiring about salary history, employers will be allowed to use information they obtain from applicants “voluntarily and without prompting”. Employers should prepare for this bill to go into effect by updating job applications and ensuring policies and procedures are up to date.
