Title VII and Transgender Individuals

U.S. Attorney General Jeff Sessions released a memo that revises “the treatment of transgender employment discrimination claims under Title VII of the Civil Rights Act”. Attorney General Sessions states that transgender individuals are not protected by federal law from workplace discrimination “based on sex”, and that the term “sex” applies “only to discrimination between men and women and does not encompass discrimination based on gender identity, per se, including transgender status”.

The Attorney General did include that the Justice Department “must and will continue to affirm the dignity of all people, including transgender individuals”.
