US Department of Labor Withdraws Guidance on Independent Contractors
The US Department of Labor (USDOL) has announced that it is “withdrawing its Obama-era guidance on independent contractors”. The statement notes that the removal of the previous definition “does not change the legal responsibilities of employers under the Fair Labor Standards Act” and that “the department will continue to fully and fairly enforce all laws within its jurisdiction”. Employers should review their independent contractor/employee classifications with counsel to evaluate any potential issues.
